The rules surrounding the scattering of cremated remains aren’t that simple. It’s not illegal to scatter cremated remains, but where it’s done can complicate things. At Willowbrook Cemetery, many clients ask us this question, so here is some helpful information.

Is It Permissible To Scatter Cremains On My Property?

Cremains can be scattered on any private property, so you can do this on-premises that you own without worry. However, if you want to spread them on someone else’s property, you need the property owner’s permission. Many people also scatter cremains in water, and there are no legal implications to this aspect.

However, you cannot bury cremated remains or an urn with ashes on any municipal land or provincial park. It is also why many people busy their loved one’s ashes at a cemetery. We have many families coming in with these requests, and we provide the required space and markers as needed.

Cremation is becoming a preferred option today, and many cemeteries are considering expanding their boundaries. If you want to scatter your loved one’s remains on your land, you can do so without worrying about legal repercussions or breaking the law.
